Collaborative Divorce: What it looks likeThe collaborative process is completely private decision making process where you retain control over every decision. You along with your attorney commit to finding private solutions which are in the best interest of all family members. No court appearances are necessary. Both parties have access to legal counsel throughout the process. Everyone agrees to exchange all information pertaining to income, assets and debts. The process also makes use of outside experts and neutrals to advise the family. These neutrals are financial advisors or appraisers, psychologists, and others. The attorneys with the participation of the couple, draft the final documents to be filed with the court. You are free to end the collaborative process at any time you choose to conduct formal court proceedings against each other. However, in that event, the collaborative attorneys are required to withdraw from representation. This is because both partners need the assurance that their collaborative attorneys are truly looking out for their best interests, and are not secretly preparing for a costly court battle.
